A Missoula man is heartbroken and angry after a day of cross-country skiing with his malamute dogs near Lolo Pass turned into his worst nightmare Sunday afternoon.

Layne Spence was skiing with his three dogs on a quiet logging road in Lee Creek when, according to Spence, a rifle shot echoed through the air.

Then, Spence saw his 2-year-old brown and white dog, “Little Dave,” fall down with a shot to a leg.

About 15 yards away from him and his dogs, Spence saw a man in camouflage holding an assault weapon.

“I started screaming ‘Stop, stop,’ and the man kept shooting,” said Spence, 48, and who is often seen walking his dogs around Missoula’s river front. “And he kept shooting.”

“My dog is lying there, dead and I shouted ‘What are you doing?’ and the guy said, ‘I thought it was a wolf.’ ”

After the man allegedly shot Spence’s dog six times, he took off without another word, leaving Spence to deal with the tragedy of his dead dog.

Spence abandoned his skiing gear to carry Little Dave out, and to get his other two malamutes, Frank and Rex, to the safety of his truck.

When he got back to Missoula, Spence filed a report with the Missoula County Sheriff’s Department.

“This doesn’t have to happen,” said an obviously distraught Spence. “Not every big dog is a wolf. These are pets, they all had their collars and lights on, they were all with me the entire time.

“People need to know what a wolf looks like before they start shooting,” he said. “And I was standing right there.

“What if I had a child on a sled, what would have happened if a bullet ricocheted?”

“There are other people who use the woods besides hunters this time of year.”}

Totally inexcusable. It's bad enough the POS kills my dog, but he then just gets up and leaves? I'd find the SOB and beat him to a bloody pulp. That POS is no hunter. He's just a scumbag with a rifle. Get him alone and he'd cry like the little bitc* he is.

  NO ! that's not the answer!
The hunter did NOT brake any laws!
What he did was inexcusable and wrong but NOT illegal.
What does Piss me off it the fact all the Pics of the dog are with it all quiet and fuzzy, that do look a lot like a wolf. The fact they HAVE to put in that it was shot with an "ASULT" rifle with a "HIGH" capacity clip. My little 10/22 holds 10 shots and is almost an auto. My 1895 Marlin hold 10 super magnum 45 cal bullets and I can shoot it very fast. ALL of which are just as devising to a dog.
BUT NO EXCUSE for shooting the wrong target, and the bad PR that's sure to fallow...
 Here is what was on the front page of our Paper. I wish the shooter could have his say in the paper with the SAME light.

THAT'S WHY I wanted to kick his butt. Straight and to the point.

However;

I'm not up on the laws in Montana D, but I'd say you could get a charge of malicious mischief or Montana's version of that law.

I would think Montana has laws against being indiscriminate in your shooting. Most states have laws regarding firing at any target when a human is standing nearby. These vary by state.

Plus...

If he did nothing wrong, then why not stay?

To my mind he exhibited culpability by not staying. To just leave after firing a weapon close to another human brings up the possibility of mens rea. He THOUGHT he broke the law. That in most cases is grounds enough in most states for police to conduct an investigation.

Even without the criminal charge, there is an excellent case to be made in civil court. Again, you can't just destroy someones property under what is considered an egregious act.

Recover the bullet, tie it to the weapon and you own his azz. To be truthful though, 99% of those kind of cases never go to court. He gets a lawyer and they offer a settlement.

ANOTHER REASON why I'd rather beat him to a pulp.

I don't see this being able to add any real fuel to people who are opposed to wolf hunting or high capacity magazines, because neither have any real bearing on the issue at hand.

The issue is very cut and dried here. The shooter did NOT properly identify a target before shooting. He also fired his weapon in the direction of a man walking with his dogs. It comes down to reasonable expectations and assurances. YOU have a reasonable expectation to not have you or your party turned into a target. YOU have a reasonable expectation for those engaged in legal shooting activities to know the law, the weapon and the target BEFORE firing.

Both John and Bo are right.  The guy that did the shooting is a total freaking idiot for not knowing what a wolf looks like and for not knowing what was going on around him.  If the dog was that close to him, the guy was also.  If he could see the dog, he could see the man.

It's illegal in most states to kill someones pet.  I imagine it is also in Montana.  The pet owner needs to pressure the police to investigate this and find out who did it and charge them.  The pet owner should also start a civil suit against the idiot.

NO!It is NOT agents the law to shoot a dog in Montana! He was cleared of any wrong doing... He is getting sued in civil court.
